Kelvix Terms of Use

These Terms of Use (“Terms”) are an agreement between you and AVDALYAN TECH LLC, a U.S. limited liability company (“we”, “us”), governing your use of the Kelvix application (“Kelvix”, the “App”). By using Kelvix, you agree to these Terms and to our Privacy Policy and Community Guidelines, which are incorporated by reference. If you download Kelvix from the App Store, Apple's Standard End User License Agreement also applies.

1. Eligibility

You must be at least 13 years old to use Kelvix, and old enough to form a binding contract in your jurisdiction (or have a parent or guardian's permission). By using Kelvix, you confirm you meet these requirements.

2. What Kelvix is - and is not

Kelvix helps you understand food products: it shows product information, ingredient and packaging warnings, a health score, and answers from Kelvix Coach. All of this is general information, not medical, nutritional or dietary advice, and it is not a substitute for a doctor, dietitian or other healthcare professional.

• Product data comes from Open Food Facts, from other Kelvix users and from AI reading of label photos, and can be incomplete, outdated or wrong. Always check the actual packaging - especially for allergens.
• Health scores are our own simplified assessment based on the data available, as explained in the app under “How the Score Works”. They are not an official rating.
• Kelvix Coach answers are generated by AI and can contain mistakes. Don't rely on them for decisions about allergies, medical conditions, pregnancy, medication or other health matters.

3. Subscriptions and purchases

Full access to Kelvix requires a paid subscription, purchased through your Apple ID via the App Store. The price and billing period are shown in the app before you buy.

• Payment is charged to your Apple ID account when you confirm the purchase.
• The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the current period ends.
• You can manage or cancel your subscription at any time in your device's Settings > Apple ID > Subscriptions. Cancelling stops future renewals; you keep access until the end of the period you have paid for.
• Refunds are handled by Apple under its own policies. You can request one at reportaproblem.apple.com. This does not affect any mandatory consumer rights you have where you live.

4. Acceptable use

You agree to use Kelvix in line with our Community Guidelinesand all applicable laws. You agree not to submit false or misleading product information, misuse the reporting feature, try to get around usage limits, scrape or bulk-download data from Kelvix, interfere with or disrupt the service, or reverse-engineer the App beyond what's permitted by law.

5. Products you add

When you add a product or fill in missing information, you confirm that it comes from the product's actual packaging. You give us a worldwide, royalty-free, perpetual licence to store, review, edit, display and share that product information as part of Kelvix's product database, so that other users can benefit from it. Product information may be reviewed, corrected, hidden or removed at any time - for example after reports from other users.

6. Reporting and enforcement

You can report wrong or inappropriate product information in the app. We review reports and may hide or remove content, and block a device from adding or reporting products, if these Terms or the Community Guidelines are broken.

7. Intellectual property

Kelvix, its design, scoring, texts and software belong to AVDALYAN TECH LLC. Product data from Open Food Facts is available under the Open Database License (ODbL) and its product photos under Creative Commons BY-SA, as credited in the app.

8. Disclaimers

Kelvix is provided “as is” and “as available”. We work hard to keep the information accurate and the service running, but we can't guarantee that product information, scores or Coach answers are complete, correct or up to date, or that the App will always be available or error-free. To the fullest extent permitted by law, we disclaim all warranties.

9. Limitation of liability

To the fullest extent permitted by law, AVDALYAN TECH LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for decisions you make based on information in Kelvix - including about allergies, diet or health. Nothing in these Terms limits liability that cannot be limited by law.

10. Changes to these Terms

We may update these Terms as Kelvix evolves. We'll update the “Last updated” date above and, for material changes, notify you within the app.

11. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you have under the laws of the country where you live.
